Tory Lanez, serving a 10-year sentence for the 2020 shooting of Megan Thee Stallion, continues to seek avenues to overturn his conviction. Despite his efforts, recent petitions challenging his conviction have been rejected, although a direct appeal remains pending. With this crucial appeal still on the horizon, the rapper’s legal team aims to address perceived trial errors and maintain hope for a different outcome.
Denied Petitions Fail to Sway Court
An appellate court in California recently dismissed two habeas corpus petitions filed by Lanez, intending to invalidate the jury’s verdict due to allegedly overlooked evidence or issues. Despite these setbacks, the direct appeal regarding the original trial proceedings remains active, with oral arguments set for Monday.
The three-judge panel stated that Lanez’s claims didn’t fulfill habeas relief requirements. One petition falsely claimed the firearm involved in the case was missing, which the judges refuted based on a sworn LAPD statement confirming all evidence remained secured.
Moreover, Lanez’s failure to request further DNA testing raised questions from the judges, who noted that additional testing was unlikely to change the outcome. The inconclusive DNA results on the firearm were already presented during the trial.
Claims of New Witnesses and Evidence
The appellate tribunal also rejected a second petition involving supposed new testimony. Lanez’s team introduced an affidavit by his driver, Jauquan Smith, claiming he saw the gun in another person’s hands before the shooting. However, the tribunal noted that Smith was not called as a witness by Lanez’s defense during the trial, undermining the validity of this claim.
The judges also dismissed statements from a bodyguard, Bradlie James, as they were submitted late and deemed “untimely.” These delayed claims, the judges argued, did not justify a piecemeal presentation of habeas corpus petitions.
Direct Appeal Still Hopeful
Meanwhile, Lanez’s direct appeal focuses on alleged trial errors, including the claim that the judge improperly allowed emotional testimony from Megan Thee Stallion and that his defense attorney provided ineffective counsel. His team also argues that prosecutors engaged in misconduct during their closing arguments. These issues will be addressed during the upcoming oral arguments.
The appeal remains a beacon of hope for Lanez and his legal team as they attempt to overturn his conviction. As this high-profile case unfolds, all eyes will be on the courtroom proceedings next week.
Currently serving time at the California Men’s Colony, Lanez, 33, continues to insist on his innocence. The outcome of his direct appeal will be pivotal in determining his future.
