Renowned actor and director Kevin Costner finds himself embroiled in a legal battle over allegations concerning a controversial scene in his latest project, “Horizon 2.” Accused by a stunt performer of forcing an unscripted rape scene, Costner has vehemently denied these claims, labeling them as “patently false” and damaging to both him and the film.
Costner’s Firm Rebuttal
In a court filing, Kevin Costner sought to dismiss the lawsuit brought against him, arguing that the accusations were intended to tarnish his reputation. He asserted that the claims were sensationalized to provoke unnecessary public outrage and obtain monetary compensation. “I can only assume that purpose was to use this sensationalistic language to embarrass and damage me and the ‘Horizon’ movies,” Costner stated, describing the situation as “an absolute nightmare.”
The Allegations at the Heart of the Lawsuit
The lawsuit, filed by stunt performer Devyn LaBella, alleges that Costner orchestrated an unscripted scene simulating rape, thereby violating union protocols. According to LaBella, Costner improvised a scene during which an actor acted aggressively towards her, contravening established filming guidelines by lacking proper planning and communication. The film’s intimacy coordinator corroborated these lapses, indicating a lack of essential protective measures on set.
However, Costner contends that the scene was misconstrued, emphasizing that it was designed to suggest off-screen actions rather than depicting a direct assault. He maintains, “This was one artistic shot designed to imply what was going to happen off-screen, and purposely was not a ‘simulated rape.’”
Legal Maneuvers and Defense
Costner’s legal team has moved to strike down the lawsuit under California’s anti-SLAPP statute, which serves to shield entities engaged in free speech on matters of public interest. Marty Singer, Costner’s attorney, argued that “Horizon 2” explores the brutal realities faced by women in the post-Civil War American West, including their susceptibility to violence, and therefore deserves protection under this law.
Testimonies from various crew members, including Roger Ivens, who participated in the scene with LaBella, supported Costner’s position, describing LaBella’s account as overstated and misleading. “It is not what happened,” Ivens insisted, clarifying that there was no simulation of sexual activity during the shot.
Contentious Reactions and Accusations
Wade Allen, the stunt coordinator, who was responsible for overseeing LaBella, also dismissed the allegations, asserting that the scene involved no intimate content whatsoever. He recounted LaBella’s positive demeanor and willingness throughout the filming process. “At no point that day did she evidence any distress or discomfort,” Allen noted.
In response, LaBella’s attorney, James Vagnini, criticized the motion as a tactic to evade responsibility, asserting that Costner’s influence in Hollywood is being used to sidestep accountability. “This filing is continued evidence that one of Hollywood’s most powerful men is trying to skirt accountability for reckless and harmful behavior,” Vagnini remarked.
The legal dispute over “Horizon 2” continues to unfold, with significant implications for both the film’s release and those involved in the production. As the case progresses, the veracity of the allegations and their impact on Costner’s long-standing career will be brought to light.
