Legal Action Amidst Unpaid Rent Dispute
Denise Richards has initiated court proceedings to remove her estranged husband, Aaron Phypers, and his family from their shared Los Angeles rental property. This step comes after Richards discovered that Phypers had not been fulfilling his rent obligations, leading to a formal eviction notice. According to court documents obtained by Page Six, the television star is asking the court to mandate Phypers and his relatives vacate the Calabasas home, enabling her to retrieve her personal items, including her pets, while adhering to an existing temporary restraining order.
Brief Background of Their Split
Richards, 54, and Phypers, 52, officially parted ways in July. Although both names are listed on the lease, Richards contends she vacated the premises two years ago, believing Phypers’ family would only occupy the house temporarily. In her filing, she emphasized that she had informed Phypers he would be responsible for the rent beginning in January, yet he and his family have reportedly remained at the property without plans to leave.
Landlord’s Struggles and Property Condition
The landlord has purportedly made numerous attempts to reach Phypers concerning the overdue rent over the last six months, but has been unsuccessful. As a troubling result, the landlord moved to evict Phypers with a deadline set for August 23. Richards stated in her court filing that she had left many personal belongings at the residence, fearing they could be damaged or discarded during the eviction process. She emphasized, “If I am not able to [retrieve] my dogs and belongings, I believe my dogs will be harmed and my property destroyed or discarded during the eviction process.”
Evidence of Damage and Strain
In her court documents, Richards expressed her dismay over the condition of the home, describing it as being in “a state of disarray.” She provided photographic evidence showing unopened boxes, scattered clothing, and debris throughout the property. “I was shocked at the condition of the home, having not lived there for over two years,” she remarked, pointing to the severe damage allegedly caused by Phypers and his family.
Richards has advocated for a court order to enforce Phypers’ removal from the residence, allowing her to secure her belongings. The tension between them escalated recently, leading to a police visit when Richards arrived to collect her dogs. In a separate account, Phypers reported feeling fearful for his family’s safety in light of Richards’ assertive arrival, capturing the ongoing unrest stemming from their breakup.
Both parties continue to navigate this complex situation, with Richards having secured a temporary restraining order against Phypers in light of her allegations of past abuse during their marriage—claims that he has publicly denied.
